Which entries sit outside CAPE
CBP has excluded several entry types from its CAPE refund phases, including:
- Entries subject to antidumping or countervailing duties (AD/CVD)
- Warehouse entries (entry types 21 and 22)
- Drawback-related entries
- Entries with open or suspended protests
- Entries that are suspended, extended, or under review
CBP has also run CAPE in phases, so an entry that was not eligible in one phase may become eligible in a later one. Check CBP's current guidance for your entry types.
What routes may remain
Depending on the entry, the answer may be waiting for a later phase, a post-summary correction, a protest, or court action. Which one applies depends on the entry type, its liquidation status, and dates. Several of these filings must be prepared by a licensed customs broker or an attorney.
