CBP has scheduled Phase 3 of its CAPE refund tool to begin October 6, 2026. Phase 3 covers finally liquidated entries subject to court-ordered reliquidation.
- As of September 11, 2026, CBP reported $134.7 billion in potential and certified refunds accepted, and $122 billion certified and sent to Treasury for payment.
- About $1.3 billion across 20,184 refunds was pending because of missing ACH refund information.
- CBP has said Phase 3 refunds will be processed only for importers who filed their own lawsuits at the Court of International Trade.
What it means: importers with finally liquidated entries who have not filed a case should speak with a trade attorney about their options and deadlines. Importers still waiting on refunds should confirm their ACH details are on file.
