On August 29, 2025, the U.S. Court of Appeals for the Federal Circuit, sitting en banc, affirmed 7-4 the Court of International Trade's May 28, 2025 ruling in V.O.S. Selections that the IEEPA tariffs were unlawful. The court stayed its decision to allow the government to seek Supreme Court review, and the government petitioned the Supreme Court on September 4, 2025.
